The Fifth Court of Appeals just issued an opinion and judgment in the case of Burleson, et al. v. Collin County Community College District. opinion-and-judgment
The court of appeals overturned the trial court judgment against the plaintiffs and remanded the case for trial.
The whistleblower suit reinstated by this ruling was filed on August 28, 2014. That means the wronged officers in this case have been litigating for nearly 2 1/2 years, and they are only now able to begin the process of getting to trial.
Lawyers are familiar with the aphorism that justice delayed is justice denied. This case is an example of that truth.
