Selling a Haunted House

What if you are selling a house that you believe is haunted or that has some other psychological stigma such as the occurrence of a murder? Do you need to disclose that? Marc Ben-Ezra and Asher Perlin have written an article on the topic.

Apparently the answer varies from state to state. But you may not be safe in assuming that, because ghosts aren’t real, you need not disclose. If the reputation of the house depresses its market value, courts in some states may regard that as material even though the court rejects the existence of ghosts.
